Description:
An online advertisement for glasses was promoting a buy one pair and get the second pair for free offer. However, the terms and conditions of the 2 for 1 offer stated that it was buy one at regular price and get the second one for 30% off.
Complaint:
The complainant alleged the advertisement gave the misleading impression the second pair was free.
Response:
Although Ad Standards requested a response from the advertiser, there was no response sent to Council.
Decision:
Council reviewed the advertisement without the benefit of a response from the advertiser.
Council found that the prominent claim of a “free” second pair created a general impression that the consumer would receive a second pair of glasses at no additional cost. However, the terms and conditions required the consumer to pay 70% of the regular price for the second pair.
Council unanimously came to the conclusion that the advertisement contained a misleading claim contravening Clause 1(a) of the Code.
